Estate Planning in the UAE - “Ignorantia Juris Non Excusat”
06 Feb 2024
The UAE has experienced exponential growth since its formation in 1971, and the “pull-factor” has been strong amongst investors.
While the region offers some exciting prospects, the reality of human fragility can’t be avoided, and it’s the responsibility of every person residing in the UAE to ensure that they not only understand the culture, but also the laws in place, or as the the legal maxim goes “Ignorantia Juris Non Excusat,” or “Ignorance Of The Law Excuses Not.”
It should be understood that generally speaking, expat legal professionals do not hold the relevant standing in the local UAE courts (“locus standi,”) and as such we must look towards those firms who are able to file matters with the applicable authorities. We act in close collaboration with local advocates to conclude matters, and in providing the most accurate legal assistance possible.
Whenever a person dies within the UAE, it’s essential to understand the intricate processes involved in reaching the point whereby the division of the estate may occur.
It must be said that we have encountered numerous clients who have turned to us for assistance, after having initiated the process with another entity that does not necessarily possess the experience within this very specialist field. The result has been that of providing clients with either incorrect legal guidance, and, or providing guidance which is incomplete.
Should you need further guidance on the processes involved following the death of a loved one, kindly refer to the below links.
