Husband and wife, both non-Muslims, are resident in Dubai with their two minor children. They do not own substantial assets in this jurisdiction but are concerned about the care of their children in the event of both of their deaths whilst still living in Dubai. How can they ensure their chosen guardians take control and responsibility of their children in this situation?
Inheritance laws in the UAE allow Non-Muslim individuals to make Wills in accordance with the laws of the country of their nationality. These Wills can name permanent guardians to take care of the children in the event of the death of both parents. A temporary guardianship document can also be put in place to name temporary guardians to take care of the minor children in the interim period until the named permanent guardian take custody of them. Alternatively, the couple may put guardianship- only Wills in place and register these at the DIFC Wills and Probate Registry
